PRIVATE PATENT - CONVENTION The present convention has as object to regulate the conditions of use of the site Private Patent. LENGTH: The present contract takes effect to count as from its signature for a length of a (1) year, renewable by tacit renewal for successive contractual periods of the same length, except denunciation having written notified at least two (2) months before the expiration of ongoing contractual period. 6. THE RIGHTS OF POSSESSION OF PRIVATE PATENT: The contents of the Portal (text, software, music, sounds, photographs, pictures, videos, layout and design of pages) either quite other present support on the Portal, as well as any information introduced by Private Patent or by the Customers are protected by authors' rights, trademarks, brevets, or other rights and laws of ownership. Private Patent can show pictures and text through the Portal including the posting of messages of partners and Customers. The customer du Portail be able to show, re-format and print the contents accepted through the Portal only for their personal usage and for not commercial aims. The Customer also promises not to change, to copy, to reproduce, to republish, to download, to show, to transmit, to sell or to distribute no way available contents on the Portal, including computer code and software. 7. AVAILABLE INFORMATION: Certain information and available data on the Portal are produced by customers de Private Patent, of this fact Private Patent cannot guarantee the exhaustive and appropriate, precise, dependable character of this information and will incur no responsibility in this title. Particularly, Private Patent is not responsible for the quality of information and can be kept under no circumstances for representative, directly or indirectly, of any loss, or caused or supposed damage caused by use or trust in any available contents on the Portal and offered by a Customer. 8. DISCHARGES AND GUARANTEES: Elements provided by Private Patent and/or the customers de Private Patent via the Portal are delivered without any guarantee or condition of no kind, definite or implicit. The Portal contains links towards information written by thirds over who Private Patent can practise no permanent control or take any responsibility as for their contents. Private Patent cannot be kept for representative as part of a litigation happening between his Customers. Private obvious will try hard to provide an access to the Portal 7 days over 7 and 24 hours on 24, to be productive and support approachable all available services on the site, except operations of service and case of force majeure. Nevertheless, Private Patent does not guarantee that service will be uninterrupted or without error: in this title, the responsibility of Private Patent would under no circumstances know how to be searched in following cases: - momentary breaks of a length of some minutes for the updating of the Portal; - difficulties of functioning or momentary break of these services independently of our will, notably in case of break of the services of electricity or telecommunications; - momentary breaks of services necessary for their evolutions or service; - fault or dysfunctions of Internet network. TECHNICAL PRESSURES: To be capable of giving its services to the Customers, certain services of the Portal request the approval of cookies (a cookie is a small file sent to the navigator of the Customer and stocked in the hard disk of the computer used by the Customer). If the navigator is configuré to refuse them, the access to certain services of the Portal can turn out to be corrupted, or even impossible, by this fact Private Patent could not be responsible in case of disfonctionnement of the Portal if the Customer refused the usage of cookies. 10. LIMITATION OF RESPONSIBILITY: Private Patent can under no circumstances, to be keeping responsible for direct or indirect damage, resulting from use or from inability to use the Portal. Of same Private Patent cannot be kept for representative for purposes of menacing, defamatory, indecent, horrifying or illegal nature which would be kept contrary to a Customer by a third nor consequences of an attack on behalf of the Customer in the rights of a third. 11. MISCELLANEOUS: This convention of use and relation between the Customer and Private Patent is governed by French laws independently of any conflict of lawful dispositions. Any litigation raising interpretation or execution of the present convention will be subjected to the jurisdiction of the courts of the spring of the Court of appeal of Paris.
